COMPREHENSIVE AND METICULOUS RESEARCH BY APPLICANT TO CONVINCE ENTRY CLEARANCE OFFICER OF ELIGIBILITY

Manila, Philippines – As ECO-Friendly said during its last blog, overconfidence is the usual culprit for failed applications.

Based on ECO-Friendly’s experience British partners and the applicants for the UK Spouse Visa, UK Fiancée Visa, other UK Settlement Visa as well as UK Visit Visa would sometimes think that the documents comprising the basic requirements like the passport, proof of income, and relationship with the British sponsor is enough to show the Entry Clearance Officers (ECO) that the applicant from the Philippines is qualified for the visa applied for.

First let us talk about the main requirements that need to be complied with.
There are actually five (5) major requisites that need to be fulfilled by the Filipina applying for the UK Spouse Visa, UK Fiancée Visa, other UK Settlement Visa, as well as the UK Visit Visa:
1.       That the relationship between the British sponsor and the Filipina applicant is genuine and legitimate
2.       That the British sponsor is financially capable of supporting the Filipina applicant
3.       That there is sufficient accommodation for both the British sponsor and the applicant from the Philippines once the latter is in the UK
4.       Tuberculosis test Certificate
5.       English Test Certificate
(The last two are applicable for the UK Spouse Visa, UK Fiancée Visa and other UK Settlement Visa only and is not required for the UK Visit Visa unless the applicant will be visiting and staying in the UK for more than six (6) months.)

ECO-Friendly would also like to stress that aside from the TB Test Certificate, all applicants likewise need to pay for the Immigration Health Surcharge (IHS) if they will be staying in the UK for more than six (6) months.

Going back to the 5 requirements listed above, the applicant for the UK Spouse Visa and UK Fiancée Visa must also submit documents that will support all her answers to the application.

As an example, under question number 1.21 of the financial form which the Filipina applicant must attach with the application form, there is a question asking the applicant, “Have you or your sponsor previously been married/or entered into a civil partnership?”

If the applicant from the Philippines had a previous marriage which has been dissolved due to annulment of the marriage or death of the other spouse, then a valid decree from the Regional Trial Court (RTC) of the Philippines and the corresponding Certificate from the PSA must be attached in the case of annulment or a valid PSA issued Death Certificate must be attached with the application.

On the other hand, if the application is for a UK Visit Visa, documents to prove that the applicant will return to the Philippines must be filed with the application (This will be next topic of the ECO-Friendly blog).

ECO-Friendly always reminds its readers to be meticulous and see to it that everything which the Entry Clearance Officer (ECO) wants to see must be properly attached in the application to avoid a negative result. Thus, submission of the basic requirements is normally not sufficient and it is up to the applicant to make the proper research and study to determine what other documents need to be filed in order to convince the Entry Clearance Officer (ECO) that the applicant for the UK Spouse Visa, UK Fiancee Visa or any other UK Settlement Visa as well as a UK Visit Visa is truly qualified.

OVERCONFIDENCE - THE USUAL CAUSE OF REFUSALS

Manila, Philippines - Based on the actual experience of ECO-Friendly, the leading cause of application refusals of most applicants for the UK Spouse Visa, UK Fiancée Visa, or a UK Visit Visa is usually the over-confidence on the part of the Filipina applicant and her British sponsor.

It is not uncommon for the Filipina applicant and her British partner (spouse, fiancée or same-sex partner) to assume that the documents they presently have in their possession are sufficient enough to warrant a favorable result from the Entry Clearance Officer (ECO) that will decide their application.

By the way, in Manila, a recent order has been issued which took effect a few months ago ordering the applicants from the Philippines to personally send the packet of supporting documents to the UKVI Sheffield office.

Before this order to send the documents at the Sheffield Office, it was the Entry Clearance Officers (ECOs) based here at the UK Embassy in Manila who decided whether to grant or refuse a visa application.

With the recent order, however, the applicant needs to send the supporting documents to the Sheffield office (whether by scanning at the VFS UK Philippines, or by private courier), where the ECOs based in Sheffield will decide on the fate of the application (this will be the subject of another article).

Now back to the main issue. As ECO-Friendly was saying, in gathering the supporting documents for the UK Visa application, since the only basis of the Filipina applicant for the UK Spouse Visa, UK Fiancée Visa or UK Visit Visa is the list provided by the UK government website, then they will only obtain and collect the documents enumerated in this list.

The list of evidence provided in the website is not that comprehensive and so if the applicant for the UK Spouse Visa, UK Fiancée Visa, any other UK Settlement Visa or UK Visit Visa follows, complies and gather these documents, they feel assured and confident that the application is more than sufficient to merit an approval.

But this is not the case. The Filipina applicants and their British partners should read the notice above the list which states that: “This checklist is for you to identify which documents you are submitting with your application. It is not a list of documents which you must provide but rather an indication of the types of documents that are commonly submitted.”

The Philippine applicant for the UK Spouse Visa, UK Fiancée Visa, or any other UK Settlement Visa, as well as a UK Visit Visa should realize that the batch of supporting documents which each applicant should collect and gather is generally on a case to case and personalized basis.

ECO-Friendly would like to reiterate that each applicant generally has a specific personal detail and circumstance which is distinct and different from the other applicants and therefore what would be applicable (a particular set of documents) for one Filipina applicant may generally be not applicable to another Filipina applicant.

It is therefore very essential for the applicant to initially study and make a thorough research on what supporting documents are relevant to her, and not just accept the list in the UK website or adopt the list of supporting documents of another applicant which may be completely different from hers.

Of course there are the basic legal documents that are generally applicable to everyone like the passport, birth certificate, marriage certificate, etc…. These are the main documents that each and every applicant for the UK Spouse Visa and UK Fiancée Visa or UK Visit Visa must attach with the application.
