CONSEQUENCES OF DECEPTION IN AN APPLICATION

Manila, Philippines - Under the UK Visas and Immigration website, FALSE REPRESENTATION is defined as a situation, “…when an applicant or third party lies or makes a false statement in an application, either orally or in writing.”

Applicants for a UK Spouse Visa, UK Fiancée Visa or any other UK Settlement Visa lodging their applications in the UK Embassy - Philippines must understand that they should never resort to deception when filing their application because this will lead to a very significant tragic consequence.

The UKVI website adds that, “The application must be refused even if the false representation is not relevant to the application… and even if the applicant was not aware that false representations, information or documents have been used.”

ECO-Friendly, however, explains that minor inaccuracies, must not be considered as deception as defined under the rules. The application of the Filipina applying for the UK Spouse Visa or UK Fiancée Visa will not, therefore be refused, just because there was a slight mistake in the address of the sponsor or an error in the type of employment of the British boyfriend or husband.

It is also worthwhile to note that the intention of the applicant for the UK Spouse Visa or UK Fiancée Visa is not a paramount concern and therefore, even if the applicant who submits the false document was not aware of the falsity of the paper he or she includes in the application, it shall be refused by the Entry Clearance Officer (ECO).

According to the UKVI website, the ECO must refuse the application if the latter has sufficient evidence that a false document has been submitted even if the false document is not relevant to the application or the decision and even if the applicant is unaware that the document is false.

It is therefore up to the applicant of the UK Spouse Visa or UK Fiancée Visa to ensure that all documents that have been submitted are legitimate and authentic and not spurious.

The UKVI website specifies what constitute FALSE DOCUMENTS:

A false document includes: a genuine document which has been altered or tampered with; a counterfeit document (one that is completely false); a genuine document that is being used by an impostor; a genuine document which has been fraudulently obtained or issued; or a genuine document which contains a falsified or counterfeit visa / endorsement.

ECO-Friendly remembers how we bumped into the beautiful Ms. Rhose at the VFS-Global Philippines office a year ago, just like it was yesterday.
