APPLICANTS NEED TO BE NATIONALS/RESIDENTS OF THE COUNTRY WHERE THE APPLICATION IS LODGED

It is an essential requirement that the applicant for the UK Spouse Visa, UK Fiancée Visa or any UK Settlement Visa be a resident of the country where he or she is applying.

One reason for this requisite is for the UK Embassy to easily determine the character and criminal record of the applicant.

If the applicant for the UK Spouse Visa, UK Fiancée visa or any UK Settlement Visa has a pending criminal record in any courts in the country of residency or nationality, or has been convicted of any felony or serious offense, it would not be very hard for the embassy to verify the moral integrity of the applicant if the latter is a resident or national of the country where she is applying for.

Thus, if the Filipina is temporarily out of the country, say for example Hong Kong, at the time she intends to file for the US Spouse Visa or UK Fiancée Visa, the wiser plan would be to go home to the Philippines first and file the application from your home country.

In the application for the UK Spouse Visa or UK Fiancée Visa there is a question, “Are you a national of the country in which you are applying?” the preferable answer would be “YES.”

As stated earlier, the reason is that the embassy wants to make sure that the applicant is presently in her country of nationality or residency at the time she lodges the application.

In the event, however, that the Filipina applicant for the UK Spouse Visa or UK Fiancée Visa is not in her country of nationality (Philippines) at the time of the filing, BUT IS A RESIDENT (legally) of the country where she is going to file the application, this may also be allowed under the rules.

ECO-Friendly explains that under this situation, the applicant will need to show the details of her permission to stay in the country of application.

If, for example, the Filipina applicant for the UK Spouse Visa or UK Fiancée Visa is in Singapore working as a computer expert, all she has to do is present evidence of her legal stay in Singapore and also prove that she is allowed by the government of her home country, the Philippines, to work as an Overseas Filipino Worker (OFW) in Singapore.

If, however, she is merely a temporary resident visiting Singapore, the application will automatically be refused if she files the application in Singapore.
