SETTLEMENT VISA VS VISIT VISA

Manila, Philippines - ECO-Friendly has lately been receiving several questions from applicants of the UK Spouse Visa and UK Fiancée Visa asking for clarification or more information as to what is the better application to apply for, a UK Settlement Visa (UK Spouse Visa / UK Fiancée visa) or a UK Visit Visa?

To put the issue to rest, once and for all, ECO-Friendly Blog will discuss the pros and cons.

If you are the Filipina fiancée or spouse of a British citizen or a UK resident with plans to go to the UK, the first thing you should do is decide whether you want to go there to settle permanently or you just want to visit and get an initial feel of the place before you take the plunge and migrate for good.

ECO-Friendly would like to reiterate that this article is for Filipina spouses or fiancées of British citizens OR residents only, who cannot make up their minds and are having difficulty deciding on whether they should file for a UK SETTLEMENT VISA (UK Spouse Visa or UK Fiancée Visa) on one hand and a UK VISIT VISA on the other.
 
KNOW THE FACTS

The initial thing to consider before making any decision is to know the requirements for each type of visa. Obviously, if you know the eligibilities and qualifications for each type of UK Visa, you will have a better understanding on which visa category to choose, as well as the implications of your choice.

As an example, once you have a full grasp of the eligibilities for both types of visa, UK Settlement Visa (SPOUSE/FIANCÉE) or UK Visit Visa, you will be able to determine whether you are qualified for either or both.

Thus, based on this knowledge, if you are eligible for one of the visa and not qualified for the other, then the only thing for you to do is apply for the visa in which you are qualified! Your choice is now narrowed down to the visa type which you are eligible for. It’s that simple!

Once you know that you are not qualified for one type and very eligible for the other, the only way to go is choose the type of visa which will be approved.

Let’s say you have a stable and high-income employment here in the Philippines and at the same time you have a British boyfriend who is very much in love with you. He asks you to stay with him in the UK, either for the Christmas season or for good.

You also dearly love the guy and the eventual plan is for both of you to settle in the UK.

However, you are having second thoughts and cannot decide on whether to just visit the UK for the holidays, or finally tie the knot with your British fiancée. In the first case, you need to file for a UK Visit Visa, in the second, a UK Fiancée Visa.

However, the guy is still in the process of dissolving his marriage and the divorce proceedings is still pending with Her Majesty’s Courts. Under this scenario, the UK Fiancée Visa cannot prosper since the element of "No Legal Impediment to Marry" is not sufficiently complied.

Thus, your next and only option is to file for a UK Visit Visa. Since you are financially capable of travelling, having a fulfilling career, and a loving family who will be left behind here in the Philippines, your chances of travelling to the UK on a Visit Visa has a high rate of success.

​ENGLISH LANGUAGE TEST AND TUBERCULOSIS TEST FOR APPLICANTS OF THE UK SETTLEMENT VISA

Manila, Philippines - The two most important documents that need to be attached to the application whenever filing for either a UK Spouse Visa or a UK Fiancée Visa are the English Language test and the Tuberculosis Test results.

If the applicants for the UK Spouse Visa or UK Fiancée Visa lodge the application without these two documents, the application will automatically be denied even if they are truly eligible for the visa they are applying for.

The UK Embassy guys in the Philippines, however, are lenient when it comes to a missing pay slip or an omitted bank statement. In these cases, they sometimes write an email to the applicant instructing the latter to send the Embassy a copy of the missing pay slips or bank statements.

But in the case of the TB Test or English Language Test results, if the applicant fails to attach the documents to prove they passed the two tests, the applicant can kiss her more than PHP95,000 embassy application fee goodbye.

ECO-Friendly disclosed that in the Philippines, there are only two accredited English Language testing centers. On the other hand, there is only one Tuberculosis testing clinic recognized by the UK Embassy to conduct the test within the whole Philippines.

Applicants for the UK Spouse Visa or UK Fiancée Visa usually line up at these testing centers hoping they will pass the two tests in order to get a step closer to their dream of permanently living in the UK one day.

ECO-Friendly reveals that passing the English test is not that difficult since the whole process takes only around fifteen minutes.
In the Philippines, the main purpose of the English Language Test is to determine that he applicant for the UK Spouse Visa or UK Fiancée visa is knowledgeable in the English language, enough for her to communicate with her British partner and to survive the daily activities while in the UK.

Mere basic knowledge of the English language is the key to passing the test and this is the main reason why the test is comprised of SPEAKING AND LISTENING only.

Meantime, the TB test is of course conducted to determine whether the applicant for the UK Spouse Visa or UK Fiancée Visa does not have Tuberculosis before he or she enters the UK.

All applicants, including their children, except if the child is below 11 years of age are required to undergo the TB test.

However, these exempted children will have to undergo an interview or oral examination to determine if they need to be screened for the TB or not.

The test fee does not include any treatment should the applicant for the UK Spouse Visa or UK Fiancée Visa is later determined to be diagnosed with tuberculosis.
