SETTLEMENT VISA VS. VISIT VISA Part 2

Manila, Philippines - Over the years, ECO-Friendly has given its Filipino and British readers countless ideas and tips on how to increase the chances of approval of their applications for the most sought after UK Spouse Visa, UK Fiancée Visa or any other UK Settlement Visa.

Oftentimes we even spot and observe hits from our competitors in the immigration industry surfing this website and probably catching the latest UK Immigration news via our ECO-Friendly site and most likely taking notes of our latest information and updates about the UK Spouse Visa or UK Fiancée Visa.

During our last blog, we made a comparison between filing for a UK Settlement Visa (either the UK Spouse Visa or the UK Fiancée Visa) and a simple UK Visit Visa.

In that blog, we discussed that the Visit Visa is the proper route if the applicant is not qualified for the UK Fiancée Visa or UK Spouse Visa.

According to the last blog, “…if you are eligible for one of the visa and not qualified for the other, then the only thing for you to do is apply for the visa in which you are qualified! Your choice is now narrowed down to the visa type which you are eligible for. It’s that simple!

“Once you know that you are not qualified for one type, say the UK Fiancée Visa or UK Spouse Visa and very eligible for the other (UK Visit Visa), the only way to go is to apply for the type of visa which will be approved.

“Let’s say you have a stable and high-income employment here in the Philippines and at the same time you have a British boyfriend who is very much in love with you. He asks you to stay with him in the UK, either for the Christmas season or for good.
“You also dearly love the guy and the eventual plan is for both of you to settle in the UK.

“However, you are having second thoughts and cannot decide on whether to just visit the UK for the holidays, or finally tie the knot with your British fiancée. In the first case, you need to file for a UK Visit Visa, in the second, a UK Fiancée Visa.

“However, the guy is still in the process of dissolving his marriage and the divorce proceedings is still pending with Her Majesty’s Courts. Under this scenario, the UK Fiancée Visa cannot prosper since the element of "No Legal Impediment to Marry" is not sufficiently complied.

“Thus, your next and only option is to file for a UK Visit Visa. Since you are financially capable of travelling, having a fulfilling career, and a loving family who will be left behind here in the Philippines, your chances of travelling to the UK on a Visit Visa has a high rate of success.

BUT WHAT IF YOU ARE QUALIFIED FOR BOTH THE UK VISIT VISA AND THE UK SETTLEMENT VISA/UK FIANCÉE VISA? WHAT WILL BE THE ISSUES THAT NEED TO BE CONSIDERED?

Now comes the tricky part. If you are eligible for both the UK Visit Visa and the UK Fiancée Visa, then you have to ask yourself whether you want to settle in the UK with your British partner for good, or you just want to test the waters and see if you will love the UK way of life.

In case of the former (UK Fiancée Visa), here are the issues that you must take into consideration. Ask yourself the following questions:
  1. Is your relationship with your British boyfriend / fiancé genuine?
  2. Are both you and your British boyfriend allowed to get married in the UK?
  3. Is your British boyfriend/fiancé capable of supporting both your financial needs before and after the wedding?
  4. Will both of you have suitable accommodation before and after the scheduled wedding?
If you answered YES to all the questions, then you may be eligible for the UK Fiancée Visa and the next step would be to show concrete proof to the embassy that you are qualified.
