As we enter our third year here in our Ortigas office, ECO Immigration Consultancy, or simply “ECO-Friendly” has learned so many lessons which has made our firm one of the most sought after UK immigration consultancy in the area.
 
It all started nine years ago when our office was still located within a residential area along P. Tuazon Blvd. in Cubao, Quezon City. Since this humble beginning, we have gone through so many transformations and changes, encountered all types of clients and filed so many applications for different types of UK visas, passports and appeals to Tribunals.
 
We can therefore say, we have almost seen it all. Emphasis on the word “almost” since nobody can really say they have seen it all!
 
In the course of our operation, probably one of the most important lessons that we have learned in the filing for a UK Spouse Visa, UK Fiancé/Fiancée  Visa or any other UK Settlement Visa as well as the UK Visit Visas and British passports here in the Philippines is that there is nothing more essential than an application equipped with a complete set of supporting documents to fully reinforce each and every declaration in the application.
 
Many times, during our initial evaluation and interview of prospective clients, they almost always assert the completeness of their documents.
 
“We are already in possession of the complete set of documents,” or “...kumpleto na po ang mga papel namin!” were the usual retorts when asked on the sufficiency of documents, only for ECO-Friendly  to determine later that they still have a good deal of documents to gather before we can truly declare the sufficiency of their papers and before they can pass the strict investigation of the Entry Clearance Officers (ECO).
 
There were also numerous instances when past clients who consulted us initially, and later decided to file the application on their own without our assistance, come back to us, almost in tears because their shot at filing the UK spouse visa on their own did not receive a positive result and the Entry Clearance Officer (ECO) did not think they attached the sufficient amount of documents to prove that the applicant is truly qualified for the application being applied for.
 
So many applicants who were previously refused would come to us and when we review the reason for the failure and investigate the documents they attached with their application, we realize that they could have easily passed the scrutinous eyes of the ECO had they only attached the correct and applicable documents to prove their qualification.

SUITABLE ACCOMMODATION FOR UK SPOUSE VISA APPLICANTS

Manila, Philippines - In filing for a UK Spouse Visa, UK Fiancée Visa or any other UK Settlement Visa, it is very essential that the applicant specify the exact address where he or she will stay in the United Kingdom.

Primarily, the applicant is expected to stay in the house of the British sponsor or partner while she is in the UK. Proof required may either be utility bills for the said residence, Council tax bills or other valid documents that show the true residential address of the partner from the UK.

However, there are instances when the British husband or partner does not have his own house as he is renting or residing in the house owned by another person like the latter’s parents, siblings or friends.

ECO-Friendly explains that to prove accommodation in an application for a UK Spouse Visa or UK Fiancée Visa, ownership of the house is not the main issue. Thus, it is not important if the British spouse or partner actually has title to the house but mere possession of the house where the applicant and the British sponsor will live is more controlling.

In the case where the British spouse or sponsor does not own the house but rents it from a landlord who owns the property, this is perfectly alright since he still has the right to possess the house. Thus mere right to possess the house is sufficient to comply with the rule on accommodation.

As long as the property can suitably accommodate the British sponsor, the applicant from the Philippines, and in some cases their children, there will be no problem with regard to complying with the requirement on proper lodgings.

There are even instances when the accommodation or housing is in the form of a boathouse owned by the British husband.

In the past, one of the clients of ECO Immigration Consultancy approached our office for assistance and asked if it was alright to file her application for the UK Spouse Visa even if her British husband lived on a boat.

Mrs. Fara Grassing went to ECO Immigration Consultancy in February 2019 for consultation worried that her husband Keith’s boathouse may not be sufficient to comply with the rules on accommodation.

ECO-Friendly assured her that a boathouse as residence for purposes of complying with the UKVI rules on housing or accommodation was perfectly valid and we went on to file the application.

On 26 March 2019, we filed the application using her husband’s boathouse address as her accommodation. On 19 June 2019 or less than 90 days later, her visa application was approved and she is now happy in the UK living in the boathouse together with her husband Keith (https://www.ukvisa-eco-friendly.com/eco-friendly-blog/congrats-to-fara-and-keith).

On the other hand, there are also instances when the British sponsor is living with the parents, siblings or friends. Again this is also applicable and perfectly alright.

The only issue that must be considered is that the property must be large enough to suitably accommodate all the residents of the house including the applicant for the UK Spouse Visa or UK Fiancée Visa who will soon also be staying in the same house if and when the application is approved.
