Aside from their passport and UK visa, all holders of the UK Spouse Visa, UK Fiancée Visa and UK Settlement Visa are also required to carry their Biometric Residence Permits (BRPs) at all times while they are in the United Kingdom.

The biometric residence permit is main proof that the holder has the right to “stay, work or study” in the UK. It is one of the main requirements that the UK Spouse Visa, UK Fiancée Visa or UK Settlement Visa holder can use if he or she wants to open a bank account in the UK.

The UK government’s main purpose in requiring applicants for the UK Spouse Visa, UK Fiancée Visa and other UK Settlement Visa to obtain the Biometrics Residence Permit (BRP) is to help protect the identities of these legitimate and genuine applicants. Because showing the BRPs to the UK authorities will make it easier, simpler and faster for these people to prove their true immigration status in the UK.

The BRP contains the appropriate information which UK authorities need in order to determine the true identity of the BRP holder, such as the latter’s name, fingerprints, signature, photo, gender, nationality, date of validity, etc.

ECO-Friendly stresses that all UK Spouse Visa, UK Fiancée Visa and another UK Settlement Visa applicants as well as other UK Visa applicants from 6 years and above who plan to stay in the UK for more than six (6) months are required to have their biometrics taken at the time they apply for the visa at their country of origin, and the details and information obtained during the filing of the visa application shall be indicated in the Biometrics Residence Permit.

According to a UK government website, “…The holder is  not  required  to  carry  their permit at all times, but they must show it at the border, together  with  their  passport,  when  travelling  outside  of, and when  returning  to,  the  United  Kingdom.”

“The same UK website states that, “Your biometric residence permit is evidence of your permission to stay in the United Kingdom, and shows the conditions of your stay.  It enables you  to  confirm  your  identity and  your  rights  to  study  and/or  work  here, and to access public services.

“You may have to show the permit to the immigration officer at the border when you leave the United Kingdom.

“You will also have to show it as well as your valid national passport or travel document before you begin your return journey, and again    when    you    re-enter    the United Kingdom. 

“The  permit  proves  that  you  are allowed to return to the United Kingdom, but it  cannot  be  used  instead  of  a  passport or travel document,” the website states.

The UK Spouse Visa, UK Fiancée Visa or other UK Settlement Visa applicant shall receive information on how to obtain the Biometrics Residence Permit after the application is officially filed with the UK government.

DOMESTIC WORKERS IN PRIVATE HOUSEHOLDS

After writing continuous entries about applications for the UK Spouse Visa, UK Fiancée Visa and other UK Settlement Visas, ECO-Friendly now writes about the “DOMESTIC WORKERS IN PRIVATE HOUSEHOLDS.”

The UK immigration rules initiated this type of visa (DOMESTIC WORKERS IN PRIVATE HOUSEHOLDS) on 18 September 2002.

According to the rules, as provided in a UK government website, the applicants for the DOMESTIC WORKERS IN PRIVATE HOUSEHOLDS can do the following:


  1. Accompany their employer to the UK and receive leave for a maximum of 12 months at a time
  2. Change employers in the UK provided they continued to be employed as a domestic worker and meet the other requirements of the route
  3. Become eligible to apply for indefinite leave to remain when they had completed 5 years continuous lawful residence 

However, on 6 April 2012, the UK government amended the rules and limited the period of stay of the DOMESTIC WORKERS IN PRIVATE HOUSEHOLDS applicants to a mere six (6) months.

Also, the rules were changed as to the status of the employer of the applicant. According to the new rule, “Changes made to the Immigration Rules on 6 April 2012 limit entry in this capacity to established domestic workers WHO ACCOMPANY THEIR EMPLOYER VISITING THE UK.”

This means that aside from the six months limit of stay in the UK, the intent of the employer of the applicant for the DOMESTIC WORKERS IN PRIVATE HOUSEHOLDS should only be to VISIT the UK.

ECO-Friendly, however, would like to stress that this new rule is applicable only to applicants who entered the UK before 6 April 2012.

For those who entered before 6 April 2012, “they can still extend their leave” and still “…are eligible for indefinite leave to remain (ILR) after they have completed 5 years, providing they meet the full requirements of the rules when they apply.”

TUBERCULOSIS TEST

Applicants for the UK Spouse Visa, UK Fiancée Visa or other UK Settlement Visas need to undergo a Tuberculosis (TB) Test before their application can be considered and approved by the Entry Clearance Officer (ECO).

According to the rules, applicants (including those coming from the Philippines) who plan to come to the UK for a period of more than six (6) months needs to submit themselves to a TB test at the only accredited TB Test clinic in the Philippines.

Thus, ECO-Friendly reminds that aside from UK Spouse Visa, UK Fiancée Visa and other UK Settlement Visa applicants, other applicants for other visas like Dependants of Tier 2 Visas, Dependants of Sudent Visas, etc. likewise need to undergo the test.

With regard to Visit Visa applicants, they are only exempt from the required TB Test if they plan to stay for less than six (6) months.

ECO-Friendly cites the list of applicants who are exempt from the TB Test:
  1. Diplomat accredited to the UK
  2. A returning UK resident who haven’t been away for more than 2 years
  3. Applicants who have lived for at least 6 months in a country where TB screening is not required by the UK, and you’ve been away from that country for no more than 6 month

​Children of UK Spouse Visa, UK Fiancée Visa and other UK Settlement Visa applicants who will travel to the UK with the principal applicant who are below 11 years old are exempted from taking the TB Test.

ECO-Friendly would like to inform applicants that if the child is above 11 years of age, the authorized clinician shall have the discretion on whether the child need to undergo the TB test or not after careful consultation and interview.

If the applicant for the UK Spouse Visa, UK Fiancée Visa and other UK Settlement Visa is pregnant, they can choose from the three (3) options below:
  1. Continue with the x-ray with an extra shield to protect the pregnant applicant as well as the unborn child in the 2nd and 3rd trimesters
  2. Undergo a sputum test (phlegm coughed up from your lungs) – under this option, the applicant for the UK Spouse Visa, UK Fiancée Visa and other UK Settlement Visa will be asked to wait for the result which may be released after two (2) months or more.
  3. Or the applicant may just wait until after delivery
The result of the TB test is usually released after around one to two hours after the procedure.
