If you are the Filipina fiancée or spouse of a British citizen or a UK resident with plans to go to the UK, the first thing you should do is decide whether you want to go there to settle permanently or you just want to visit and get an initial feel of the place before you take the plunge and migrate for good.
ECO-Friendly would like to reiterate that this article is for Filipina spouses or fiancées of British citizens OR residents only, who cannot make up their minds and are having difficulty deciding on whether they should file for a UK SETTLEMENT VISA (UK Spouse Visa or UK Fiancée Visa) on one hand and a UK VISIT VISA on the other.
KNOW THE FACTS
The initial thing to consider before making any decision is to know the requirements for each type of visa. Obviously, if you know the eligibilities and qualifications for each type of UK Visa, you will have a better understanding on which visa category to choose, as well as the implications of your choice.
As an example, once you have a full grasp of the eligibilities for both types of visa, UK Settlement Visa (SPOUSE/FIANCÉE) or UK Visit Visa, you will be able to determine whether you are qualified for either or both.
Thus, based on this knowledge, if you are eligible for one of the visa and not qualified for the other, then the only thing for you to do is apply for the visa in which you are qualified! Your choice is now narrowed down to the visa type which you are eligible for. It’s that simple!
Once you know that you are not qualified for one type and very eligible for the other, the only way to go is choose the type of visa which will be approved.
Let’s say you have a stable and high-income employment here in the Philippines and at the same time you have a British boyfriend who is very much in love with you. He asks you to stay with him in the UK, either for the Christmas season or for good.
You also dearly love the guy and the eventual plan is for both of you to settle in the UK.
However, you are having second thoughts and cannot decide on whether to just visit the UK for the holidays, or finally tie the knot with your British fiancée. In the first case, you need to file for a UK Visit Visa, in the second, a UK Fiancée Visa.
However, the guy is still in the process of dissolving his marriage and the divorce proceedings is still pending with Her Majesty’s Courts. Under this scenario, the UK Fiancée Visa cannot prosper since the element of "No Legal Impediment to Marry" is not sufficiently complied.
Thus, your next and only option is to file for a UK Visit Visa. Since you are financially capable of travelling, having a fulfilling career, and a loving family who will be left behind here in the Philippines, your chances of travelling to the UK on a Visit Visa has a high rate of success.
