MEETING THE FINANCIAL REQUIREMENT

In order for the application for a UK Spouse Visa, UK Fiancée Visa or any other UK Settlement Visa to be successful, one of the main requirements which the applicant needs to comply with is the Minimum Income Threshold.

ECO-Friendly stresses that under the Minimum Income Threshold requirement, it is the duty of the applicant for the UK Spouse Visa, UK Fiancée Visa or any other UK Settlement Visa to show, by means of documentary evidence, that the applicant, or their partner, or both, meet the financial requirement of earning at least £18.600 annually.

According to UK Immigration Rules, the applicant must meet:
  1. The level of the financial requirement applicable to their application; and
  2. The requirements specified as to:
    1. the permitted sources of income/savings; and
    2. the time periods and permitted combinations of sources applicable to each permitted source relied upon; and
    3. the evidence required for each permitted source relied upon.
The UK immigration rules also states that, “Income and cash savings must be in the name of the applicant, their partner or jointly. However, income and cash savings of a dependent child of the applicant can also be included once the child has turned 18 years of age.

ECO-Friendly, however explains that the £18,600 minimum income threshold is not applicable to all applicants of the UK Spouse Visa, UK Fiancée Visa or any other UK Settlement Visa, since this financial requirement shall also be conditioned on whether an additional applicant, say the child of the applicant, is also filing for a separate visa to enter the UK together with the parent applicant.

To explain, ECO-Friendly would like to clarify that if the minor child of the applicant wants to come to the UK with the mother for the purpose of likewise settling in the UK, the rules mandate that an additional amount be fixed for the minimum income threshold.

ECO-Friendly would like to stress that the child applicant in this case is not the natural child of the British partner or sponsor but the child of the applicant for the UK Spouse visa, UK Fiancée Visa or UK Settlement Visa with another partner.

No additional financial requirement is needed if the child is the natural child of the British sponsor since the child is considered as a UK national upon birth (this will be tackled in another blog).

Going back to the issue at hand, according to the UK immigration law, “… a gross annual income of £3,800 is required for the first child sponsored in addition to the £18,600 required for the partner, and an additional £2,400 for each further child.”

Hence:
  • Partner with no children                               £18,600
  • One child in addition to the partner               £22,400
  • Two children plus partner                             £24,800
  • Three children plus partner                          £27,200

“If the higher financial requirement and other requirements are met, the child or children will be granted leave in line with the migrant partner. If the migrant partner and child or children are applying together, and the higher financial requirement and other requirements are not met, all the applicants will be refused,” according to the rules.
